General Terms and Conditions
These General Terms and Conditions (GTC, German: AGB) apply to all orders placed through our online shop. Our online shop is exclusively intended for consumers.
A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession. An entrepreneur, in contrast, is a natural or legal person or a partnership with legal personality who, when entering into a legal transaction, acts in the exercise of their trade, business, or profession.
Contractual Partner, Conclusion of Contract, Correction Options
The purchase contract is concluded with Christiane Mauer. By placing products in our online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. The contract is concluded by accepting the offer for the goods contained in the shopping cart by clicking the "Place Order with Payment Obligation" button. Immediately after submitting the order, you will receive a confirmation by email.
Language of the Contract
The language available for concluding the contract is German.
Delivery Terms
Currently, deliveries are only possible within Germany. In addition to the stated product prices, shipping costs will be added. Details regarding the amount of shipping costs can be found in the respective offers. Deliveries to packing stations are not possible for logistical reasons.
Payment
In our online shop, the following payment methods are generally available:
- Credit Card: You provide your credit card details during the order process. Your card will be charged immediately after submitting the order.
- PayPal: To pay the invoice amount via PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction will be carried out by PayPal immediately after submitting the order. Further information will be provided during the ordering process.
Retention of Title
The delivered goods remain the property of the artist Christiane Mauer until full payment has been received.
Transport Damage
If goods are delivered with obvious transport damage, please complain about such defects as soon as possible to the delivery agent and contact us immediately. The failure to make a complaint or contact us will not affect your statutory rights, especially your warranty rights. However, early notification of such claims helps us assert our own claims against the carrier or transport insurance.
Warranty, Liability, and Guarantees
Application of statutory warranty rights: Unless explicitly agreed otherwise below, statutory warranty rights apply. The following limitations and shortening of periods do not apply to claims for damages due to:
- injury to life, body, or health,
- intentional or grossly negligent breach of duty by us, our legal representatives, or agents,
- breach of significant contractual obligations, the fulfillment of which enables the proper execution of the contract and on which the contractual partner regularly relies (cardinal obligations),
- within the scope of a guarantee promise, if agreed, or if the scope of the Product Liability Act applies.
Limitations against Consumers
If a defect occurs more than one year after delivery of the goods, claims for defects are excluded. Defects occurring within one year from delivery of the goods can be asserted within the statutory limitation period of two years from delivery of the goods.
In case of slight negligence in breach of significant contractual obligations, on which the contractual partner regularly relies (cardinal obligations), our liability is limited to foreseeable, typical damages. We are not liable for other damages caused by simple negligence. Liability for claims due to the absence of a warranted quality remains unaffected.
Dispute Resolution
The European Commission provides a platform for online dispute resolution (OS), which you can find at http://ec.europa.eu/consumers/odr/. We are neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
